12 Regulatory Changes Your
Existing Policies Don’t Cover

The 2025 Minnesota Legislature fundamentally changed how EIDBI agencies are regulated. Policies written before these changes are missing critical requirements that DHS will be looking for.

Provisional Licensing Created

§245A.142 — Didn’t exist before 2025. Your old P&P has zero reference to it.

DHS Unannounced Inspections

Effective July 1, 2025 — DHS OIG can now inspect without notice. Old P&P has no inspection readiness section.

DHS Leads Maltreatment Investigations

Effective July 1, 2025 — DHS replaced county agencies as lead investigator for EIDBI programs.

Chapter 260E Replaced §626.556

Maltreatment of Minors Act was recodified. Old P&P citing the repealed statute is immediately flagged.

Background Studies Must Be Completed First

Effective August 5, 2025 — Staff cannot work while studies are pending. The old exception is gone.

Employees Only — No Independent Contractors

Level I, II, and III providers must be agency employees. ICs cannot provide direct EIDBI services.

Behavior Analyst Licensure Required

Effective January 1, 2025 — BCBAs must hold a valid MN license through the Board of Psychology.

Play Project & ESI No Longer Approved

These modalities were removed from DHS-approved treatment approaches. Old P&P may still reference them.

DHS Risk Level Changed to HIGH

EIDBI agencies moved from moderate to high-risk — meaning increased scrutiny on applications and operations.

Monthly Observation Telehealth Limits

Max 2 consecutive months via telehealth; the third must be in person. Old P&P doesn’t address this.

Homeschool Billing Restriction

Effective January 1, 2026 — Cannot bill for direct intervention during homeschool/virtual school instruction.

New Agency Enrollment Moratorium

Effective November 1, 2025 — No new EIDBI agencies can enroll until comprehensive licensing is established.

Frequently Asked Questions

Is the DHS application fee included in your price?
No. The $2,100 DHS application fee is paid directly to DHS through the Provider Hub portal at the final step of the application. Our $3,000 fee covers everything else — application preparation, custom P&P development, credential verification, and ongoing post-submission support.
Do you guarantee my application will be approved?
No. DHS makes the final licensure determination. What we guarantee is a complete, well-organized, and compliant application that gives your agency the strongest possible submission. We remain available to handle any DHS follow-up requests until your license is approved.
Can I use my existing P&P instead of having new ones developed?
We strongly recommend — and only offer — custom P&P development. The 2025–2026 legislative session introduced 12 major regulatory changes. Existing policies written before these changes are almost certainly missing critical requirements: DHS inspection authority, updated maltreatment reporting pathways, employee-only rules, background study changes, and more. Submitting outdated policies may delay your application or raise compliance concerns during DHS review.
What if DHS asks for more information after I submit?
That’s covered. Our post-submission support runs from the day you submit until your provisional license is approved. We handle document re-uploads, clarifications, and any administrative responses DHS requests. No time limit and no additional charges.
How long does the process take?
Typically 2–3 weeks from intake to submission, depending on how quickly you can gather required documents (articles of organization, workers’ comp, QSP credentials, etc.). We provide a detailed checklist at your initial consultation so you know exactly what’s needed. Once we have everything, we can usually build and submit within a few business days.
Do you provide legal advice?

What happens if I miss the May 31, 2026 deadline?
